Agreement to Terms
By downloading, accessing, or using Medify ("Application", "Service"), you agree to be bound by these Terms of Service ("Terms"), together with our Privacy Policy and Medical Disclaimer, which are incorporated by reference. If you do not agree to these Terms, do not use the Application.
You must be at least 18 years of age to create an account and use this Application. By using Medify, you represent and warrant that you meet this requirement.
Operator
Medify is operated by an individual developer in Malaysia. References to "we", "us", or "our" in these Terms refer to the operator of Medify as the legal party responsible for the Application.
Use Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use Medify for personal, non-commercial purposes only. Under this licence, you may not:
- Modify, copy, or create derivative works of the Application or its content
- Use the Application for any commercial purpose or public display
- Attempt to decompile, reverse engineer, or extract source code from the Application
- Remove any copyright, trademark, or proprietary notices from the Application
- Transfer your licence or access rights to another person
- Attempt to gain unauthorised access to the Application or any related systems
- Transmit viruses, malware, or any harmful or disruptive code through the Application
Medical Disclaimer
Medify is a reference tool only and is not a medical device. The Application is designed for billing transparency, bill organisation, and informational analysis. It does not provide and must not be used for medical advice, diagnosis, clinical decision-making, treatment planning, recommendations, emergency triage, regulated health determinations, financial advice, insurance advice, or legal advice.
Extraction accuracy varies by document quality and format. Always verify extracted information against your original bill. Always consult a qualified healthcare provider for medical questions.
See our Medical Disclaimer document for full details.
Accuracy and Scope of Service
Medify does not warrant that information extracted from bills is complete or error-free, that the Application will operate without interruption or defect, that any defects will be corrected within a specific timeframe, or that the Application is free from vulnerabilities or malicious code.
The Service is not designed for summary bills or handwritten documents; processing these document types may result in significant extraction errors. Scanned documents and low-quality images may also produce reduced accuracy.
You are solely responsible for verifying extracted information against your original bill and for making any medical or financial decisions based on professional advice, not on output from this Application.
Medify output should not be treated as evidence that a charge is incorrect, unlawful, excessive, refundable, or medically unnecessary. Any billing queries should be directed to your hospital's billing department.
User Responsibilities
- Use the Application only for lawful purposes and in accordance with these Terms
- Not upload bills or documents belonging to other persons without their authorisation; in the case of minor dependants, you confirm parental or guardian authority; in the case of other adults, such as a spouse or parent, you confirm you have obtained their consent
- Not attempt to gain unauthorised access to the Application or other users' accounts
- Keep your account credentials confidential and notify us immediately of any unauthorised access
- Not use the Application in any way that could damage, disable, or impair its functionality
- Comply with all applicable laws and regulations in connection with your use of the Application
Intellectual Property
The Application, including all software, design, content, and materials, is the property of the operator of Medify and is protected by applicable intellectual property laws. You may not reproduce, distribute, transmit, or create derivative works from any part of the Application without prior written permission.
You retain ownership of all documents and data you upload to Medify. By uploading, you grant us a limited licence to process, store, analyse, and display your content for the private Service and to publish eligible data-minimised bill-line observations as public price evidence, as described in the Privacy Policy. This licence does not extend to retaining your identifiable uploaded documents or account-linked records beyond the periods described there.
Account Suspension and Termination
We reserve the right to suspend or terminate your access to the Application if you violate these Terms, engage in fraudulent or harmful activity, or if continued access poses a risk to other users or the service.
User-initiated deletion: You may delete your account at any time from within the Application. Account deletion currently requires password verification. If additional sign-in methods are introduced in future versions, additional verification steps may be required before processing account deletion. Upon confirmation, your account deletion request is processed:
- Your authentication account is hard-deleted after password verification
- Your associated database records are deleted according to the Service's deletion workflow
- Uploaded document files, extracted data, processing logs, audit records, backups, and other records are handled according to the retention schedule and exceptions described in the Privacy Policy, and some cleanup steps may occur asynchronously
- Some records may be retained temporarily for security, fraud prevention, legal compliance, or audit purposes as described in the Privacy Policy.
Dispute Resolution
We aim to resolve all concerns directly and promptly. Before initiating any formal legal proceedings, you agree to:
- Contact us at support@medify.my with a written description of your concern
- Allow us 30 days from receipt to respond and attempt to resolve the matter
- If the matter is not resolved within that period, either party may escalate to formal proceedings under Section 14 (Governing Law).
Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions or regulatory changes, cloud infrastructure failures or outages by third-party providers, pandemics, or any other event outside our reasonable control. We will use reasonable efforts to minimise the impact of such events and resume normal service as soon as practicable.
Paid Features
Medify is currently provided free of charge. If paid features or subscription tiers are introduced in the future, they will be subject to additional payment terms presented to you at the time of purchase, including pricing, billing cycles, and cancellation rights. Continued use of any paid feature constitutes your acceptance of the applicable payment terms.
Service Availability
We do not guarantee uninterrupted access to the Application. We reserve the right to modify, suspend, or discontinue any feature or aspect of the Application at any time, with or without notice, including for scheduled maintenance or infrastructure updates. We will not be liable for any unavailability or changes to features.
Third-Party Services
The Application integrates with third-party services for infrastructure, processing, and authentication. We are not responsible for the availability, reliability, or data practices of those third-party services beyond the contractual safeguards described in our Privacy Policy.
These third-party services may process and store data in multiple regions, including the United States, the European Union, and Asia-Pacific, as further described in the Privacy Policy.
Limitation of Liability
To the maximum extent permitted by Malaysian law, the operator of Medify will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Application, including but not limited to loss or inaccuracy of extracted bill data, decisions made in reliance on Application output, loss of revenue, profit, or business opportunity, and any medical, financial, or personal consequences arising from use of the Application.
This limitation applies even if we have been advised of the possibility of such damages. To the maximum extent permitted by Malaysian law, our total liability for any claim arising from use of the Application shall not exceed the amount paid by you to us in the 12 months preceding the claim, or MYR 50, whichever is greater, except where liability cannot lawfully be excluded or limited.
Indemnification
You agree to indemnify and hold harmless the operator of Medify from any claims, losses, damages, costs, or expenses, including reasonable legal fees, arising from your unlawful use of the Application, your material violation of these Terms, your violation of any applicable law, or content you upload to the Application without proper authorisation.
Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it valid, or if not possible, severed. The remaining provisions shall continue in full force and effect.
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, by notice within the Application. Continued use of the Application following any changes constitutes your acceptance of the updated Terms.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these Terms or your use of the Application shall be subject to the exclusive jurisdiction of the courts of Malaysia, Kuala Lumpur, subject to the dispute resolution process in Section 9.
Entire Agreement
These Terms of Service, together with the Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and the operator of Medify regarding the Application and supersede all prior agreements or understandings relating to the same subject matter.
